Your Family Circle reserves the right at any time after receipt of your information via the form to accept or decline your request for any reason. Your Family Circle is not responsible for requests that cannot be supplied or unsuccessful application requests arising from an applicant’s ineligibility to qualify for the service opportunity.

IN NO EVENT SHALL Your Family Circle (OR ITS LICENSORS, AND SUPPLIERS) BE LIABLE CONCERNING ANY SUBJECT MATTER RELATED TO THE SERVICE REGARDLESS OF THE FORM OF CLAIM OR ACTION (WHETHER IN CONTRACT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), FOR ANY (A) MATTER BEYOND ITS REASONABLE CONTROL, (B) LOSS OR INACCURACY OF DATA, LOSS OR INTERRUPTION OF USE, OR COST OF PROCURING SUBSTITUTE TECHNOLOGY, GOODS, OR SERVICES, (C) INDIRECT, PUNITIVE, INCIDENTAL, RELIANCE, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES INCLUDING, BUT NOT LIMITED TO, LOSS OF BUSINESS, REVENUES, PROFITS, OR GOODWILL, OR (D) DAMAGES, IN THE AGGREGATE, IN EXCESS OF AMOUNTS PAID TO Your Family Circle BY USER (AND RETAINED BY Your Family Circle HEREUNDER DURING THE PREVIOUS 12-MONTH PERIOD) OR US$50.00, WHICHEVER IS GREATER.

Indemnification

User agrees to defend Your Family Circle and its employees, contractors, officers, directors, and representatives against any action or suit by a third party arising from any transaction with Your Family Circle or another User, User’s use of the Service, or User’s breach of any representations, warranties, or covenants under this Agreement. User also agrees to indemnify Your Family Circle for settlement amounts, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) awarded and arising from such a claim.

Agreement to Arbitrate

Any disputes or claims arising from or related to your use of our Services shall be resolved exclusively through final and binding arbitration between us and you. The Federal Arbitration Act governs the interpretation and enforcement of this Agreement to Arbitrate.
